What we handle

Our practice covers the full spectrum of property law, from straightforward residential transfers to complex multi-party disputes and development advisory work.

Residential conveyancing

We manage the legal transfer of residential property from contract review through to settlement day. Every search, requisition and adjustment is handled so you can focus on moving in rather than worrying about fine print. Our team liaises with banks, agents and the other party's solicitor on your behalf.

Property disputes

Boundary disagreements, easement conflicts, adverse possession claims and co-owner disputes can stall your plans and escalate quickly. We pursue resolution through negotiation first, and through VCAT or the courts when necessary, always keeping costs proportionate to the outcome.

Commercial leasing

Lease agreements for retail, office and industrial premises require careful attention to rent review mechanisms, make-good clauses and permitted use restrictions. We draft, review and negotiate commercial leases that align with your business objectives while minimising future risk.

Subdivision and development

From two-lot subdivisions to multi-stage developments, we guide you through planning overlays, section 173 agreements, owners corporation establishment and title creation. We work alongside surveyors and planners to keep your project timeline on track.

Off-the-plan purchases

Buying before a property is built introduces unique risks around sunset clauses, specification changes and deposit security. We review the contract of sale, disclosure statement and owners corporation rules to make sure you understand exactly what you are committing to.

Estate and succession property

When property forms part of a deceased estate, the transfer process interacts with probate, family provision claims and capital gains tax obligations. We coordinate with estate administrators and the ATO to ensure clean title transfer to beneficiaries or purchasers.

Pathway Estate Law solicitors discussing a real-estate law case

Built around property, built for you

Pathway Estate Law was founded on a simple principle: property transactions and disputes deserve focused legal attention, not a generalist afterthought. Every member of our team practises exclusively in real-estate law, which means we spot issues early and resolve them efficiently.

Based in Roseview, Victoria, we serve clients across the state — from first-home buyers in the suburbs to developers in regional growth corridors. We believe in transparent fixed-fee arrangements wherever possible, so you know the cost before you commit.

Our solicitors hold current practising certificates with the Law Institute of Victoria and maintain professional indemnity insurance well above the statutory minimum. We invest in ongoing education to stay ahead of legislative changes, including recent amendments to the Sale of Land Act and the Owners Corporations Act 2006.

How we work together

Every engagement follows a clear four-phase framework designed to keep you informed and in control from the first conversation to the final outcome.

1

Initial assessment

We listen to your situation, identify the legal issues and provide a candid assessment of your options, including likely timeframes and costs.

2

Strategy and scope

We agree on the scope of work, confirm fees in writing and set clear milestones so nothing catches you off guard as the matter progresses.

3

Execution

Whether it is drafting contracts, conducting searches, negotiating terms or preparing tribunal submissions, we handle the detail while keeping you updated at every turn.

4

Completion and follow-up

We see the matter through to settlement, registration or resolution, then provide a summary of outcomes and any ongoing obligations you should be aware of.

Frequently asked questions

Answers to the questions we hear most often from property buyers, sellers and developers across Victoria.

Yes. Even a routine residential sale involves a legally binding contract, title searches, planning certificate checks, adjustment calculations and settlement coordination. A solicitor ensures the contract protects your interests and catches problems — such as unregistered easements or outstanding council orders — before they become costly surprises after settlement.

A licensed conveyancer can handle standard property transfers but cannot provide broader legal advice. A solicitor can do everything a conveyancer does, plus advise on contract disputes, tax implications, trust structures, estate planning interactions and litigation. If your transaction has any complexity at all, a solicitor offers greater protection.

We offer fixed fees for most conveyancing and leasing work, so you know the total cost upfront. For dispute resolution and development advisory matters, we provide a detailed estimate at the outset and obtain your approval before any additional work is undertaken. Disbursements such as search fees and registration costs are itemised separately.

Our primary practice is in Victoria, but we hold mutual recognition entitlements that allow us to act in other Australian jurisdictions when required. For interstate matters we can either act directly or refer you to a trusted local firm and coordinate on your behalf to ensure consistency.

In Victoria, the standard settlement period is 30 to 90 days from the date of contract, depending on what the parties agree. Electronic settlements through PEXA have made the process faster and more reliable. We keep you informed of key dates and coordinate with your lender to avoid last-minute delays.
